Terms of Service

Please read these Terms of Service carefully before using Klinkeo. These terms constitute a legally binding agreement between you and Klinkeo LLC.
1. Acceptance of Terms
By accessing or using Klinkeo ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Platform. Klinkeo reserves the right to update these terms at any time, and continued use of the Platform constitutes acceptance of the updated terms.
2. Description of Services
Klinkeo is a payment intermediation platform that connects businesses in countries where Stripe is unavailable with verified partners who hold active Stripe accounts. The Platform facilitates the matching of businesses and partners; it does not directly process payments.
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use the Platform. By registering, you represent that you meet these requirements. Businesses must be legally incorporated entities. Partners must hold a valid, verified Stripe account in good standing.
4. Partner Obligations
Partners agree to: (a) maintain an active and verified Stripe account; (b) respond to business applications within a reasonable timeframe; (c) process payments in compliance with Stripe's Terms of Service and applicable law; (d) not misrepresent their identity, capabilities, or account status.
5. Business Obligations
Businesses agree to: (a) provide accurate company information during registration; (b) use the Platform only for legitimate commercial transactions; (c) comply with applicable laws in their jurisdiction; (d) not attempt to circumvent platform fees or engage partners outside the Platform.
6. Fees and Commissions
Klinkeo charges a platform fee on each transaction processed through a match. Partners earn a commission of 3–7% per transaction, and Klinkeo retains a platform fee of 5–10%. All fees are disclosed at the time of matching and are non-refundable once a transaction is processed.
7. Prohibited Uses
You may not use the Platform to: (a) facilitate illegal transactions or money laundering; (b) violate any applicable law or regulation; (c) impersonate another person or entity; (d) interfere with or disrupt the Platform's infrastructure; (e) attempt to gain unauthorized access to any account or system.
8. Intellectual Property
All content on the Platform, including but not limited to text, graphics, logos, and software, is the exclusive property of Klinkeo or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works without prior written consent.
9. Limitation of Liability
To the fullest extent permitted by law, Klinkeo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Klinkeo's total liability shall not exceed the fees paid by you in the three months preceding the claim.
10. Termination
Klinkeo reserves the right to suspend or terminate your account at any time for violation of these terms, fraud, or any activity that may harm the Platform or its users. You may terminate your account at any time by contacting support@klinkeo.com.
11. Governing Law
These Terms are governed by the laws of the State of California, United States. Any disputes shall be subject to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California.
